Mediation in the Scottish Planning System

Thank you for opening this survey on mediation in planning. We are excited to hear from you regarding your ideas around how best to embed mediation into the Scottish planning system. 

By way of background, in July 2019 the Planning (Scotland) Act gained Royal Assent, bringing in a range of reforms to the planning system. Notably, the new Act introduces mediation into the Scottish planning system for the first time, stating that ‘Scottish Ministers may issue guidance in relation to the promotion and use of mediation’ (Planning (Scotland) Act 2019, Section 40) for a range of planning situations. Work is now ongoing to determine the appropriate means of taking mediation forward within the Scottish Planning System and considering how this could work in practice. 

The legislation requires Ministers to prepare guidance on the promotion and use of mediation by July 2021. PAS and Scottish Mediation have been asked by the Scottish Government to develop some proposals on how this could be taken forward. This interactive survey is an opportunity for you to contribute to these proposals. 

There are six short audio clips for you to listen to during which we have discussion around some initial ideas for how mediation could be taken forward in the Scottish Planning System. These are ideas put forward by PAS and Scottish Mediation to trigger discussion and are in no way set in stone. We would really appreciate it if you could listen to the clips and then fill out the survey questions to tell us what you think about our ideas, and more generally any other thoughts you have about how mediation could be embedded into the Scottish Planning System effectively. 

Each clip is only a few minutes long. You can, however, dip into different bits of the survey, only listening to certain clips or answering only certain questions. If you are able to complete the entire survey, that would be ideal, however if you only have time to complete a couple of sections or questions then then we still want to hear from you. The next few pages of this survey cover the follow topics:

Once we have all of your responses, we will prepare a report (including all comments made) which will outline some proposals and submit this to the Scottish Government. All comments will be anonymous. This will assist in the development of a consultation paper to be published later this year.
