Fermanagh and Omagh District Council (the Data Controller) has a legal duty to protect any information it collects about you.

The Council is fully committed to complying with the Data Protection Act 2018 as well as the principles of the General Data Protection Regulation (GDPR). The information you provide, as part of this consultation response, will be used to provide you with an update on the consultation process and outcomes, when the process has been completed.

Any information provided by you will not be disclosed to any other third party, unless law or regulation compels such a disclosure.

To ensure the Council complies with its statutory duty under the Northern Ireland Act 1998, we are asking all respondents to complete the Equality Monitoring section within this questionnaire, as appropriate. This information will be stored securely and
confidentially, and will not be included in any consultation report. Final reports will contain overall statistics and comments and will not include the names of any individuals. There will also be no ability to match the comments, or statistics, to any individual.

Confidentiality and Access to Information Legislation

Information provided in response to this consultation, including personal information, may be published or disclosed in accordance with access to information legislation these are primarily the Freedom of Information Act 2000 (FOIA), the Data Protection
Act 2018 (DPA) and the Environmental Information Regulations 2004 (EIR).

If you want the information that you provide to be treated as confidential, please be aware that, under the Freedom of Information Act, there is a statutory Code of Practice (section 45) with which public authorities must comply and deals with amongst other things, obligations of confidence. In view of this, it would be helpful if you could explain to us why you regard the information you have provided as confidential. If we receive a request for disclosure of the information, we will take full account of your explanation, but we cannot give an assurance that confidentiality can be maintained in all circumstances.
