Explore the origin of the recent increase in very onerous contract terms affecting the industry. What is the real intent behind them and is there a better way?

"The client doesn't really know what they want, or they want our thing to fit with a thing that they haven't finished developing yet. So we get into discussing major/minor change requests and then have a fight every time about whether this new change is major or minor". Can these debates be avoided by a different approach?

We are contracted to build something that is technically very difficult/impossible today, with the hope that we'll work out a way to do it. So the contract becomes a kind of risk-share: and if we can't build what was specified, the client more or less has to accept that we've done our best; Is there a better contracting model for situations like this?

Competitiveness/exclusivity. We try to get exclusivity so as to spread our NRCs over a large number of items but we usually don't manage to agree it. Instead, the client requires us to be competitive with other players and puts the thing out to RFP even though we haven't reached the break-even point yet. What do we do?
