Refugee Family Reunion Outside of the Immigration Rules:

This course, delivered by Ruth Budge (Migrant Law Project, Islington Law Centre) aims to give an overview of the law and process relating to applications for family reunion, with a focus on applications  made outside of the Immigration Rules. It will tackle matters that are particularly relevant to Afghan cases and will consider case studies based on the current situation in Afghanistan, but will have application to other family reunion cases.

The course is aimed at practitioners making refugee family reunion applications as well as those referring clients and supporting them with evidence gathering and other practical aspects of the entry clearance process.

We will consider who can apply for family reunion within the immigration rules and who can apply outside of the rules on article 8 ECHR (family and private life) grounds, as well as the process for making applications and the availability of Legal Aid. There will be a particular focus on how best to evidence claims and overcoming the practical obstacles faced by applicants in making applications. The course is designed to be interactive and you will be applying learning through case studies and group discussion.  It will be followed by an open discussion with a chance to ask questions and share practical experiences.
