City of York Council is consulting on a new enforcement policy.  It is intended to have a much wider scope than the existing policy which applies to the council’s regulatory services.  Nevertheless, the revised policy retains all of the considerations required by the Regulators' code, including adopting the format of that code. 

The policy is intended to demonstrate the council’s commitment to encouraging and supporting compliance and taking a proportionate approach to enforcement.  However, there are some situations in which it is proposed that formal enforcement action (as defined in the draft enforcement policy) may be considered even in the first instance.  These examples come from a previous consultation with the public and/or from officers within the various service areas who identified firm action as necessary in such instances to prevent deliberate flouting of the law.
