ANTI COPYING IN DESIGN - IP INFRINGEMENT SURVEY
The Design Act
Soon to be announced is a new coalition called THE DESIGN ACT, brought together by Anti Copying in Design (ACID). The founding members are the British Institute of Interior Design, (BIID) the British Contract Furnishings Association (BCFA), the Association for Creative Industries UK (AFCI.UK), the Lighting Industry Association (LIA) and the Design Business Association (DBA).
· The driving force of THE DESIGN ACT is to create a coalition of design led organisations with a single powerful voice on behalf of major design organisations in the UK on one single issue – intellectual property and design law reform.
· In 2014, after a strong campaign, ACID was successful in spear-heading a change in the law. It is now a crime to intentionally infringe a registered design punishable by up to 10 years in prison.
· The prime objective of the Design Act is to push forward a further campaign to ensure that the intentional infringement of an unregistered design is also a crime. As the majority of UK designs rely on unregistered design rights this will add the deterrent factor that is currently missing. This will also impact on other aspects of IP protection which are currently lacking such as 3D printing and online infringement issues, for example.
· Prior to the formal announcement we need to establish the scale of infringement in each different sector and identify the issues that you face so that we can act from a position of evidenced based discussions.
