Consultation on Proposed Changes to the Instrument and Articles of Government

* 1. Removal of the provision to appoint parent members. (Inst. 2.1.c)
Note: This in line with long standing existing College practice. The majority of further education colleges do not appoint parent members and are not required to do so. Parent / carers’ views are sought in College surveys.

* 2. Removing the provisions relating to:
  • the maximum number of staff members; and
  • staff member nomination and election process and replacing them with selection and appointment procedures which will be set out in the Standing Orders instead. (Inst. 2.1.e)

* 3. Removing the provisions relating to:
  • the maximum number of student members; and
  • student member nomination and election process and replacing them with selection and appointment procedures which will be set out in the Standing Orders instead. (Inst. 2.1.f)

* 4. Removing provisions relating to the nomination and election of academic and non-academic staff. (Inst. 2.3, 2.4, 2.5)

* 5. The appointment of up to 2 Vice-chairs instead of one Vice-chair. (Inst. 6.1)

* 6. Removal of requirements relating to periods of appointment, resignation, removal, appointment, re-appointment and terms of office of the Chair and Vice-chairs. These would be set out in the Standing Orders. (Inst. 6.5-6.11)

* 7. The addition of the power to suspend a Member from office. (Inst. 9.5)

* 8. Removal of detail relating to the arrangements for holding meetings, quorum, the proceedings of meeting, minutes and public access, to be set out in the Standing Orders. (Inst.12-16)

* 9. Clarification of the Corporation’s powers to delegate. (Art. 4.1)

* 10. Clarification of the power to co-opt committee members. (Art.4.3)

* 11. Modification of the requirement to establish a search committee so its terms of reference can be incorporated into another committee’s terms of reference. (Art. 5)

* 12. Removal of the requirement to nationally advertise for senior post holders. This will enable the Corporation to determine the appropriate arrangements for advertisement, selection and appointment of senior post holders on a case-by-case basis whilst complying with relevant legislation, principles of inclusivity and best practice.
